This policy describes how Calorii LLC collects, uses, processes, and shares consumer health data subject to Nevada law and how Nevada consumers may exercise their rights.
1. CATEGORIES OF CONSUMER HEALTH DATA COLLECTED AND HOW THE DATA IS USED
- Profile and demographic information, including age, gender, height, weight, physical condition, training experience, fitness goals, dietary goals, and lifestyle preferences, used to personalize fitness, nutrition, and wellness features.
- Fitness, activity, and connected health information, including steps, distance, calories burned, workouts, exercises, repetitions, sets, training volume, workout duration, heart rate, sleep-related metrics, and other authorized activity information, used to track progress, synchronize activity, and generate personalized insights.
- Nutrition and dietary information, including meal logs, food intake, calorie and macronutrient information, meal timing, allergies, dietary restrictions, food preferences, meal photos, saved meals, and nutrition goals, used for meal logging, nutrition analysis, food recognition, and meal planning.
- Images, visual information, and derived health information, including progress photos, body photos, before-and-after images, avatar source images, body-analysis inputs, estimated body composition, symmetry or progress indicators, and related outputs, used for body analysis, avatar creation, meal recognition, and visual progress tracking.
- AI interaction and inferred wellness information, including health-, fitness-, activity-, and nutrition-related prompts, questions, progress updates, recommendations, and inferences, used to provide AI-assisted responses, meal plans, workout guidance, body analysis, and performance insights.
- Other health, fitness, nutrition, or wellness information voluntarily submitted by a consumer, used to provide requested features, maintain account continuity, support consumers, protect security, troubleshoot issues, and comply with legal obligations.
2. CATEGORIES OF SOURCES
- The consumer directly, including through registration, onboarding, profile settings, meal and activity logging, AI interactions, customer support, and uploaded images or content.
- Devices and health or fitness platforms authorized by the consumer, including Apple Health, Apple HealthKit, Google Fit, Google Health Connect, and similar services.
- The consumer’s interactions with Calorii, including activity records, feature use, saved content, and outputs generated from information submitted by the consumer.
- Service providers and integrations used at the consumer’s direction to support AI, food and nutrition databases, health syncing, storage, processing, support, and related features.
3. CATEGORIES OF CONSUMER HEALTH DATA SHARED
- Depending on the features used, categories of consumer health data shared may include profile and demographic information, fitness and activity metrics, connected health-platform data, nutrition and meal information, images and visual data, AI prompts and interaction data, and derived or inferred wellness information. Calorii limits sharing to information reasonably necessary for the applicable service or purpose.
4. CATEGORIES OF THIRD PARTIES AND AFFILIATES
- Artificial intelligence service providers, including OpenAI, Anthropic, Google Gemini, and other AI providers used to generate requested outputs.
- Cloud hosting, database, storage, security, and technical infrastructure providers used to operate and protect the platform.
- Health and fitness platform providers, including Apple Health, Apple HealthKit, Google Fit, Google Health Connect, and similar services, when authorized by the consumer.
- Food, nutrition, barcode, ingredient, and recipe database providers used to support food search, meal logging, nutrition analysis, recipe import, food recognition, and meal planning.
- Customer support and operational service providers that process information only as necessary to assist the consumer, troubleshoot the service, or protect platform security.
- Other users, social media platforms, messaging applications, or other recipients selected by the consumer when the consumer voluntarily shares content.
- Government authorities, regulators, courts, or other parties when disclosure is required or permitted by law.
- Affiliates: Calorii LLC does not currently share consumer health data with corporate affiliates.
5. PURPOSES OF COLLECTING, USING, AND SHARING CONSUMER HEALTH DATA
- To create and maintain accounts and provide the features requested by the consumer.
- To generate personalized meal plans, workouts, nutrition guidance, body analysis, progress insights, and AI-assisted recommendations.
- To synchronize authorized health and activity data and maintain progress history.
- To process meal photos, progress photos, body images, avatar source images, prompts, and other content submitted for a requested feature.
- To provide customer support, troubleshoot errors, maintain service quality, prevent misuse, protect security, and comply with legal obligations.
- To improve the reliability and functionality of Calorii features where permitted by law and with consent where required.
6. MANNER IN WHICH CONSUMER HEALTH DATA IS PROCESSED
- Consumer health data may be entered manually, synchronized from an authorized health platform, uploaded as text or an image, generated from the consumer’s activity within Calorii, or derived through automated analysis. Calorii may store, organize, retrieve, analyze, combine, transmit, display, delete, anonymize, or otherwise process the data as reasonably necessary to provide the requested features and purposes described in this policy. Automated processing and artificial intelligence may be used to generate informational estimates, recommendations, and other outputs. Calorii applies access controls and other reasonable administrative, technical, and organizational safeguards appropriate to the nature of the data.
7. PROCEDURE FOR SUBMITTING A CONSUMER REQUEST
- A Nevada consumer may request confirmation of whether Calorii is collecting, sharing, or selling consumer health data; access to consumer health data; a list of third parties and affiliates with whom the data has been shared or sold; withdrawal of consent for collection or sharing; cessation of collection or sharing; or deletion of consumer health data.
- A request may be submitted through existing account or privacy controls made available by Calorii, including account deletion where applicable, or by emailing support@calorii.com with the subject “Nevada Consumer Health Data Request.” The request should identify the right being exercised and include enough information to locate and authenticate the applicable account. Calorii may request additional information reasonably necessary to authenticate the consumer and the request.
- Calorii will respond without undue delay and generally no later than 45 days after authenticating the request, subject to any extension permitted by law. A verified deletion request will be handled within the time required by Nevada law, including notification to applicable processors or third parties where required. Requests are processed without charge unless applicable law permits a reasonable fee for manifestly unfounded, excessive, or repetitive requests.
- A consumer may appeal a refusal by emailing support@calorii.com with the subject “Nevada Consumer Health Data Appeal” and explaining the decision being appealed. Calorii will respond to the appeal in writing within 45 days. If the appeal is denied, Calorii will provide contact information for the Nevada Office of the Attorney General.
8. REVIEWING AND REQUESTING CHANGES TO CONSUMER HEALTH DATA
- Consumers may review or update certain profile, fitness, nutrition, goal, preference, and account information through available account settings. A consumer may request correction or updating of other consumer health data by emailing support@calorii.com and identifying the information believed to be inaccurate or incomplete. Calorii may verify the consumer’s identity before making a requested change.
9. NOTICE OF MATERIAL CHANGES
- Calorii may notify consumers of material changes to this policy through an in-app notice, email, website notice, updated policy link, or another method reasonably designed to provide notice. Where Nevada law requires affirmative, voluntary consent before Calorii collects, uses, or shares additional categories of consumer health data, shares data with additional third parties or affiliates, or processes data for additional purposes, Calorii will obtain that consent before the applicable activity begins.
10. THIRD-PARTY COLLECTION OVER TIME AND ACROSS WEBSITES OR ONLINE SERVICES
- Calorii does not knowingly permit third parties to collect consumer health data over time and across different Internet websites or online services for targeted advertising or retargeting when a consumer uses Calorii. Certain analytics, performance, attribution, or advertising technologies may collect technical or usage information as described in Calorii’s general Privacy Policy, but Calorii does not intentionally provide detailed consumer health data, connected health-platform data, body or progress photos, meal photos, detailed nutrition logs, workout details, or body-analysis outputs for cross-site targeted advertising.
11. EFFECTIVE DATE
This Nevada Consumer Health Data Privacy Policy is effective July 17, 2026.
